General Terms and Conditions (GTC’s)
The following general terms and conditions (hereinafter referred to as GTCs) form the basis on which Hyve GmbH, Alpine Garden AG, capsule services AG, and chapter lucerne AG (hereinafter referred to as the hotels) provide accommodations and corresponding services to their customers and guests. By entering the aforementioned hotels, the customer agrees to these terms and conditions. “Customer” refers to the person who makes the booking. “Guest” refers to the customer and any third party invited to the hotel in connection with the booking.
Confirmation
The contract comes into effect upon the confirmation of the customer’s request by the hotels. The hotels may confirm the reservation in writing at their discretion. If a third party has made the reservation for the customer (e.g., booking.com, Hostelworld, Airbnb, Expedia, etc.), this party is liable for all obligations arising from the hotel accommodation contract as a joint debtor along with the customer, provided the hotel has a corresponding declaration from the third party.
Booking
Bookings are accepted exclusively electronically via the website or from third-party providers. For reservations made by phone or email, an explicit confirmation from the hotel’s reservation system is required for them to be valid. The various hotels will strive to accommodate all customer requests regarding booking changes. However, if the change requests involve arrival and departure dates, length of stay, additional services, or products, they are always subject to availability and the customer’s willingness to cover any additional costs.
If multiple capsules or rooms are booked, the hotels will try to accommodate the individuals of the same booking as close to each other as possible; however, no guarantee can be given.
The maximum length of stay is 14 consecutive days; however, the individual hotels may extend this period.
Cancellation Policy
The customer can cancel the booking without additional costs, provided this is done by 12:00 PM on the arrival date at the latest. In this case, the hotels will refund any amounts already paid by the customer.
If the customer received a reduced price rate (non-refundable) for their booking, it will not be refundable in the event of a cancellation due to the price reduction.
If the customer does not provide sufficient information regarding the cancellation or does not arrive by 12:00 AM on the arrival date (no show), the booking will be canceled. The customer must pay the total amount of the booking in this case.
The hotels may cancel a booking at any time due to circumstances beyond their control. In this case, the hotels will refund the entire booking amount, including all booking fees.
The hotels may cancel a booking at any time if the payment details provided by the customer are invalid and the customer does not provide valid alternatives within 24 hours.
Group Bookings
For group inquiries for 10 or more people, please contact us via email for individual processing at info@capsulehotel.ch. The hotels may reject any group bookings made online if they have not been contacted beforehand. Group bookings may be subject to advance payments and adjusted cancellation policies. Bookings for 2 or more nights may also be subject to advance payments and adjusted cancellation policies.
Guests must provide the exact age, date of birth, name, first name, passport number, and email address of the group members (groups under 18 years old will only be accepted by arrangement). Groups must pay the total cost of the reservation at least one month before arrival. Delayed payments will result in the rooms being resold.
Payment
Payment should generally be made cashless by card. 100% of the amount is to be paid before check-in. A valid credit card is required to secure the reservation. If you choose a non-refundable rate, you must pay 100% of the total amount at the time of booking. If you prefer to pay upon arrival, you must secure the booking with a credit card. The amount for the accommodation is to be paid at check-in unless otherwise instructed. We accept cash payments in CHF and EUR as well as credit and debit cards. All reservations are billed in the local currency CHF and are based on current international exchange rates. Invoices are issued in CHF.
Extras are not automatically included in the total bill and must be paid separately during your stay (e.g., the mandatory city tax, which varies per person/night and by location/hotel).
All claims against the hotels are generally considered time-barred one year after the beginning of the general statute of limitations period and depending on the knowledge of the civil court.
Personal Information
To stay at the hotels, each guest’s name, first name, date of birth, gender, residential address, passport/ID number, and a valid email address are required. Without this information, check-in is not possible, and the booking will be considered a no-show. After the stay, the deletion of this data from the booking system can be requested via email at info@capsulehotel.ch.. The data will be transmitted to the authorities in accordance with legal requirements.
House Rules
The house rules are part of the terms and conditions. In case of non-compliance with the house rules and refusal to follow the staff’s instructions, the hotels reserve the right to terminate the accommodation contract without notice and deny the guest access to the hotel. Receiving visitors, bringing animals, any commercial use, and drug consumption are strictly prohibited and will result in expulsion. Services that have already been paid for will not be refunded in this case.
Damage Clause
By clicking the checkbox, the hotel’s terms and conditions are accepted. Each guest agrees to treat their capsule/room and the common areas with care and is liable for any damage and consequential damages caused by them.
The guest explicitly agrees that using the upper capsule in the hotels involves climbing a ladder. The hotels assume no liability for accidents or injuries resulting from climbing or descending the ladder. The guest is obliged to check the condition of the ladder before use and to report any damage to hotel management immediately. Using a damaged ladder is strictly prohibited.
Minors under 18 years must be accompanied by an adult. Children under 16 years must be supervised by an adult guest during their stay. In case of damage, the hotels are authorized to charge the credit card provided at the time of booking with the total amount required to restore the damaged elements.
Liability Gym Area
Use of Alpine Garden AG’s fitness offerings is at your own risk. To the extent permitted by law, Alpine Garden AG excludes all liability for direct and indirect damages. It is the guest’s responsibility to be covered by insurance.
Jurisdiction
The place of jurisdiction for Hyve GmbH is exclusively Basel, Basel (Switzerland).
The place of jurisdiction for Alpine Garden AG is exclusively Küsnacht, Zurich (Switzerland).
The place of jurisdiction for capsule services AG is exclusively Lucerne, Lucerne (Switzerland).
The place of jurisdiction for chapter lucerne AG is exclusively Lucerne, Lucerne (Switzerland).
The terms of the T&Cs apply to Hyve GmbH, Alpine Garden AG, capsule services AG, and chapter lucerne AG.
Validity
The invalidity of one or more provisions does not affect the validity of the remaining provisions in any case. The legally ineffective provision will be replaced by an effective provision that is similar in meaning.
House Rules
The Capsule Hotels wish all guests a relaxing and inspiring stay. To achieve this for you and the other guests, we respect the personality and property of other guests and follow our rules:
By booking, you accept the house rules and the general terms and conditions of the hotel. You understand and accept that violations of the T&Cs and the house rules will result in immediate expulsion with police presence.
Smoking and any handling of fire and open flames are strictly prohibited throughout the entire house. In case of violation, we will charge a minimum fine of CHF 200.00.
The fire prevention regulations must be strictly observed. Any damage or disturbances must be reported to hotel staff immediately. Please familiarize yourself with the location of the escape routes.
Anyone who negligently triggers or tampers with the fire alarm system through cigarette smoke or other handling of fire or smoke (smoke detectors on the ceiling) or abusively activates the manual call points will bear the full cost of the automatic fire department deployment and any resulting costs.
Please observe the usage and safety instructions in the elevators. The elevator must not be used in case of fire.
Only one person is allowed to stay in a capsule at a time.
Noise must be avoided. There is a quiet policy in the capsule rooms 24 hours a day, as people may be sleeping during the day as well. In the corridors and the coffee lounge, you may talk and laugh as much as you like. It is explicitly stated that measures can be taken against the perpetrator, up to and including termination of the accommodation contract, to prevent noise disturbance in the interest of all residents.
Visitors of hotel guests can stay in the public areas but not in the rooms and capsules. Overnight stays of non-resident persons are generally prohibited. Guests use the sanitary facilities in the public area.
During the stay, guests are responsible for storing and securing their belongings. The hotel accepts no liability. A locked luggage room is available. Padlocks can be purchased in the shop.
Bringing and keeping animals in the hotel is not permitted.
Bringing and consuming alcohol and other drugs in the hotel is generally prohibited for residents and their visitors. Hotel staff reserve the right to confiscate any alcohol stored in the rooms and capsules for the duration of the stay. Illegal drugs will be reported immediately. In case of violation, a deep cleaning fee of CHF 200.00 will be charged for the capsule, and any repairs will be billed to the perpetrator.
Weapons of any kind are not allowed in the hotel.
Engaging in any personal commercial activities within our premises is not permitted.
Playing music is not allowed in the hotel. Radios, speakers, CD players, etc., may be confiscated by hotel staff at any time and held until departure.
Please close the doors when leaving the capsule and turn off the lights.
On the day of departure, the capsule must be vacated by 10:30 AM. Late check-out can be requested until the evening before.
Severe and repeated disturbances to other guests may result in the immediate termination of the accommodation contract, claims for damages, and a ban from the premises.
In cases of sexual harassment and coercion, racist remarks, and racist behavior, disciplinary measures will be taken, and the incident may be reported to the authorities.
We would like to point out that public areas in the hotel are monitored by video for security reasons.
Speaking of safety: Please familiarize yourself with the designated escape routes and the location of fire extinguishers. In the event of an alarm, follow the announcements of the security personnel and proceed to the assembly point as quickly as possible for a headcount.
